New RED II Decree in Italy; New incentive decrees and Extension of the current FER1 incentives

Renewable sources, RED II Decree: Starting from 15 December 2021

It has finally been published in the ordinary supplement 42 / L to the Official Gazette no. 285 of last November 30, the Legislative Decree of November 8, 2021, n. 199 “Implementation of Directive (EU) 2018/2001 of the European Parliament and of the Council, of 11 December 2018, on the promotion of the use of energy from renewable sources”, also known as Legislative Decree Red II (hereinafter the Red Decree II).

The new regulation will come into force starting December 15th 2021. Below is an analysis of some of the main innovations.

Purpose of the RED II Decree

The purpose of the decree is to define the tools, mechanisms, incentives and the institutional, financial and legal framework necessary for Italy to achieve the objectives of increasing the share of energy from renewable sources by 2030.

In fact, Italy intends to pursue an indicative increase in energy from renewable sources in final consumption for heating and cooling equal to 1.3 percentage points as an annual average calculated for the periods from 2021 to 2025 and from 2026 to 2030.

The standard, therefore, it has the ultimate goal of providing measures that accelerate the provisions of the National Recovery and Resilience Plan (PNRR) on energy from renewable sources, in accordance with the Integrated National Plan for Energy and Climate (PNIEC).

Extension of the current FER1 incentives

It is established that by 30 December 2021 the GSE will publish the dates of the new sessions for access to incentives with the usual procedures (auctions and register), presumably the first already in February 2022.

Furthermore the new sessions are arranged to make available the quotas for power not assigned, and possibly spread it between the categories of plants and between auctions and registers themselves.

New incentive decrees

Further decrees to incentivize the production of renewable energy are expected to be issued in June 2022; there will be three categories:

  • Energy Communities

The mechanisms of the Energy Communities obtain important improvements, in particular the extension of the perimeter to the plants under the same primary HV / MV substation and the raising of the power to 1 MW

  • Plants of less than 1 MW

Direct access will be provided for this size of plants, as was the case with the Conto Energia incentive. Self-consumption will be favored, presumably with an incentive dedicated to systems with storage.

  • Power plants greater than 1 MW

The plants must participate in competitive auction procedures on the basis of an economic offer; advantages are envisaged for plants built on “suitable areas” and on areas already occupied by plants of the same type (for example repowering).

For incentive schemes, unless the verifications required by upcoming EU regulations, the duration of the measures should have a relatively long time horizon (5 years).
